Addressing an Issue

A home is constructed from thousands of individual components, and even the highest-quality build can occasionally require minor adjustments or repairs. When an issue or disagreement arises during or after a project, clear communication and a structured approach are the fastest paths to a fair resolution.

Step 1: Communicate Directly with Your Contractor

Before escalating an issue, always reach out to your builder, remodeler, or supplier directly. Most concerns stem from simple miscommunications or minor oversights that contractors are eager to correct when brought to their attention.

When putting your concerns in writing, follow these best practices:

  • Focus on Facts: Keep your tone professional and objective, focusing strictly on specific dates, observed defects, and factual details rather than emotional reactions.

  • Verify Warranty Coverage: Review your project contract and warranty documentation first to confirm what is covered and how claims must be submitted.

  • Attach Documentation: Include clear photographs, videos, copies of relevant receipts, and previous communication logs.

  • Propose a Clear Solution: Clearly state your reasonable expectations for how and when the issue should be resolved.

  • Send via Certified Mail: Send a typed, formal letter via certified mail with a return receipt requested, and allow a reasonable window (typically 10–14 days) for a response.

Step 2: Review Contracts & Local Building Officials

If direct communication does not yield a response or resolution, gather your project records and consult local authorities:

  • Review Contractual Dispute Clauses: Check your written contract for mandatory resolution procedures, such as required notice periods or binding arbitration clauses.

  • Document Every Interaction: Keep a written log of all phone calls, text messages, emails, and site visits.

  • Consult Your Local Building Inspector: Contact the municipal or county building official who issued your project permits. They can inspect the work, review code compliance, and provide an official site report.

Step 3: Access Regional & State Resolution Resources

When a mutual agreement cannot be reached, several state, regional, and legal avenues are available to help protect your rights and resolve the dispute:

  • Arrowhead Builders Association Assistance: Contact the ABA directly. We can offer guidance and connect you with qualified professional mediators within our network.

  • Minnesota Department of Labor and Industry (DOLI): If working with a licensed Minnesota contractor, you may be eligible to submit a claim through the state’s Contractor Recovery Fund to recover financial losses from incomplete or defective work.

  • Better Business Bureau (BBB): The BBB offers formal complaint filing, neutral mediation, and arbitration services to resolve consumer-business disputes.

  • Minnesota Attorney General’s Office: File a consumer complaint or contact the Consumer Protection Hotline at (800) 621-0508 for assistance regarding contractor disputes.

  • Federal Trade Commission (FTC): For issues involving widespread unfair, deceptive, or fraudulent business practices, report details to the FTC.

  • Conciliation Court (Small Claims): For lower-value financial or contract disputes, conciliation court offers an accessible, low-cost legal option where individuals can represent themselves.

  • Legal Representation: For high-value claims or complex structural defects, consult an attorney specializing in real estate and construction law.
